We reserve the right to modify these terms at any time, and your continued use of the Service following any changes constitutes your acceptance of the new terms.
2. Service Description
Hygiene Diagnostics provides a diagnostic platform designed to help facilities managers and business owners identify and address workplace cleanliness and health compliance gaps. Our Service offers problem-first guidance, diagnostic pathways, and tailored solutions based on your specific workspace type and operational needs. The Service is intended to support your compliance efforts and operational decision-making, not to replace professional medical, legal, or regulatory advice.
3. Permitted Use
You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

- Diagnostic recommendations will result in full compliance with all applicable health and safety regulations
- Implementation of our guidance will eliminate all workplace hygiene risks
You acknowledge that workplace hygiene and health compliance are complex matters subject to evolving regulations and site-specific conditions. Our diagnostic guidance is intended to identify common gaps and suggest practical pathways; it is not a substitute for consultation with qualified health and safety professionals, legal advisors, or regulatory authorities specific to your jurisdiction and facility type.
7. Limitation of Liability
To the fullest extent permitted by Spanish law, Hygiene Diagnostics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of profits, data, business opportunity, or reputation, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from the Service shall not exceed the amount you have paid to Hygiene Diagnostics in the twelve months preceding the claim, or fifty euros (€50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Hygiene Diagnostics, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms of Service
- Your violation of any applicable law or regulation

These Terms of Service are governed by and construed in accordance with the laws of Spain, specifically the laws of Catalonia, without regard to its conflict of law principles. Any legal action or proceeding arising from or related to these terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Barcelona, Spain. You agree to submit to the personal jurisdiction of these courts and waive any objection to venue or inconvenient forum.
13. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Hygiene Diagnostics regarding the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.
